Case Dismissed!

Congratulations to John Hill and Tara Weitz for successfully achieving the dismissal of a medical malpractice claim against their client, a Psychiatrist. Plaintiff had alleged that the Psychiatrist, along with the facility in which their client worked, was negligent in prescribing an excessive amount of psychiatric medication to Plaintiff, which allegedly resulted in Plaintiff collapsing on her infant (Plaintiff’s decedent), which, in turn, caused the infant’s death by way of positional asphyxia. Throughout the litigation, there were numerous discovery disputes which weighed on the outcome of this litigation. Ultimately, Attorney Hill and Attorney Weitz were able to have the case dismissed against the Psychiatrist on the eve of trial without any contribution or settlement on behalf of their client.

Congratulations to Adam Fenstermaker and Tara Weitz for successfully acheiving the dismissal of a medical malpractice claim against their client, a pediatrician. Plaintiffs had alleged that the pediatrician, along with several other healthcare providers, failed to timely diagnose, treat and prevent the recurrence of an HSV infection in their newborn baby, resulting in severe and incurable neurocognitive injuries and impairments. Plaintiffs had alleged economic damages of more than $350 million. Attorney Fenstermaker and Attorney Weitz were able to have the case dismissed against the pediatrician on the eve of trial without any contribution or settlement on behalf of their client.

Congratulations to John Hill and Julisa A. Medina for their recent win in Luzerne County, PA. John and Julisa successfully received a complete dismissal of their client, a physical medicine and rehabilitation doctor, in a wrongful death case. Plaintiff had demanded $3 million to resolve the case, which was dismissed by summary judgment.
